As of March 1st, 2022 all short-term rentals in the City of Atlanta must comply with Ordinance 20-O-1656, also known as the Short-Term Rental Ordinance.

What part of Atlanta is impacted by the new short term rental law?

The City of Atlanta only. 

What is the definition of a short-term rental?

Rentals are defined as 30-days or less. 

How much does is cost to get a permit?

$150 initially and then $150 annual renewal. 

Where do I apply for the permit?

Online at the City's Online Permitting portal. You'll need to create an account first. 

What if I don't comply with the ordinance?

$300 per violation can be assessed. If 3 or more violations occur in a calendar year the license can be revoked and you can be barred from receiving a new license for 12 months. 

Is there a cap or limit on the number of licenses available?

No

What is the tax rate for a short-term rental in Atlanta?

8% hotel-motel tax

What are the requirements once I receive my short-term rental license?

- Post contact info to guests

- Be available for complaints

- List rental license # on listings

- No more than 2 adults per bedroom

- Notify nearby neighbors that the house is being used for short-term rentals

I only rent a room of my home, am I required to apply for a permit?

- Yes, per the regulation "No person or entity shall rent, lease or otherwise exchange for compensation all or any portion of a
dwelling unit as short-term rental unit, as defined in Section 20-1003, without first obtaining a short term rental license pursuant to the regulations contained in this chapter."
